Terms of Service Length of Booking: Please be sure to book enough time for your expected number of guests, as the artist is not always able to agree to extend a booking, due to other commitments. With arches, columns and other decor, the use of our equipment terminates at the end of your event or 11:59PM on the day of your event. Whichever is the earliest of the 2 times. Reservation Fee: After confirming the availability of services for your event, a non-refundable reservation fee of 50% of the total due is required to secure your booking date and time. Sometimes multiple parties are interested in the same dates and times, so please make this payment promptly. Your booking is not guaranteed until the reservation fee has been paid to secure the date and time. Remaining Balance Payment: If the client wishes to make an advance payment towards their remaining balance, they may request that a PayPal invoice be sent to their email address. This invoice may be paid online, or by mailed check. The remaining balance for the booking is due at or before the start time of the booking. Payments may be made online through PayPal, cash, check, and credit card. If paying by PayPal or credit card, there will be an additional 4% added to the total amount. If paying by check and it gets returned, the client will be responsible for any and all fees associated with the return of the check and collections of monies due. Possible Additional Fees: Travel fees may apply when a booking is outside of a 20 mile radius of Elizabethtown, PA or from where the artist(s) for your event are based at. It is the responsibility of the client to reimburse any parking charges or admission fees that the artist(s) must pay to get to the event location to provide their services. With arches, columns, and other decor with the exception of centerpieces, once they are placed they are NOT to be moved. If they need moved, you must get in writing authorization from The Balunguy. If it is found that a piece of equipment was moved without prior authorization there will be a fee of $100 per piece of equipment will be charged. A typical column is considered 2 pieces. The arches are considered 6, 7, 8, or 9 pieces depending upon which size you got. Cancellations/Refunds: There are no refunds for inclement weather, so please have an alternate indoor location ready just in case. The Balunguy is committed to providing all of our customers with exceptional service. When a customer cancels without giving enough notice, they possibly prevent another customer from booking. If you need to cancel your event, it must be done via email a minimum of 20 days in advance. If you cancel within the 20 day window, you will still be liable for the full amount owed. All client cancellations do not receive a refund of the reservation fee. The only exception is if both artist and client agree to cancel based on weather causing very dangerous driving conditions (extreme blizzard or hurricane weather conditions). If The Balunguy were to have to cancel due to some inability to provide their services (injury/illness/other extreme case), the client would be refunded a full refund or the The Balunguy would find a replacement artist of equal qualification. Set-Up Requirements: Access to bathroom facilities, 10 x 10 space, and 15 minutes of set-up and take-down time before and after are required. At the artists request, you may have to provide a table and chair. Please ensure that there is adequate lighting and controlled noise level at the artists location. It is important the artist can clearly see what they are doing and be able to communicate effectively with guests, for general safety and the best experience possible. If Outdoors: The artist must be protected by sun and any light precipitation with overhead shelter. The artist can provides a canopy tent for their work space for an additional $20 cost. The artist(s) at their discretion, may forfeit the opportunity for a canopy and/or table. Inclement Weather & Adverse Working Conditions: The client agrees to provide the artist with a place to work that is protected from extreme temperatures and other unpleasant weather conditions. If the event is held outdoors, the client is responsible for providing an alternate indoor location. The client agrees to pay the full amount contracted once the artist has arrived at the event location, rain or shine. The artist has the right to cease working and leave without refund if there are extreme adverse working conditions and the client fails to remedy the situation after it has been brought to the client’s attention. Adverse conditions include, but are not limited to: destructive, violent, or extreme inappropriate behavior of a person or animal; illegal activities; or otherwise dangerous conditions. Liability Statement: The artist is not liable for allergic reactions to the face paints, latex, or any other material used. People with skin allergies or sensitive skin should proceed with caution with face painting or airbrushed tattoos, by consulting with the artist and having a patch test done For safety reasons, the face painting and/or airbrushed tattoo artist will not paint anyone who does not want to be painted. For sanitary reasons, the artist will not paint anyone who is, or appears to have a contagious infection or illness. The artist will not paint on or near open wounds. These determinations are at the artist’s discretion. The artist will use reasonable care, but is not responsible for damage to clothing or property. The artist is not responsible for the supervision of children. Their behavior and safety is the Client’s and/or Parents’ responsibility. In addition, the client is responsible for repair or replacement costs of any and all equipment damaged, defaced, or stolen. Normal wear and tear is expected and accepted. Acceptance: In order to book from The Balunguy you must agree to all of the above terms and conditions. If, at any time, any of the terms or conditions are not met by the client they will have 15 minutes to rectify the situation. After that time, if the situation has not been rectified, the artist(s) may choose to leave your event with full payment and no refunds.
